These Terms of Service ("Terms") govern your use of the VinMain website (vinmain.com), the VinMain mobile applications for iOS and Android, and every feature, report, and service offered through them (together, the "Service"). By creating an account, tapping "I agree," or using the Service, you accept these Terms. If you do not agree, do not use the Service.
Summary in plain language: VinMain is a tool that helps you research a vehicle and get connected to lenders. VinMain is not a lender, does not make credit decisions, and cannot promise you will receive a financing offer. Vehicle history reports come from third-party data and can be incomplete. These Terms contain an arbitration clause and a class-action waiver (Section 15) with a 30-day opt-out.
You must be at least 18 years old and a resident of the United States to create an account or use the financing features. If you are under 18 you may not use the Service. By using the Service you represent that this is true and that any information you provide is accurate and belongs to you.
What we do. VinMain provides (a) vehicle information and history reports generated from a VIN; (b) a way to request pre-qualification or pre-approval for vehicle financing and to be connected with participating lenders; (c) tools to browse vehicles, save searches, and manage your account; and (d) the HCAR Audit Record, which lets you view and verify a sealed, tamper-evident record of automated decisions made about your application (see Section 8).
What we are not. VinMain is not a bank, credit union, lender, loan broker, or credit reporting agency. VinMain does not extend credit, set interest rates, approve or deny loans, or fund vehicles. Every credit decision is made by the lender you are connected to, under that lender's own criteria and policies. VinMain is not a party to any loan, purchase agreement, or membership agreement you enter into with a lender or dealer.
No guarantee of an offer. Submitting a financing request does not guarantee that any lender will make you an offer, that any offer will be at a particular rate or term, or that a lender will be available in your area. Lender participation varies by state and county and changes over time. When no participating lender can consider your request, the Service will tell you so.
You need an account to use most features. You are responsible for keeping your login credentials and your phone secure, and for all activity under your account. Tell us immediately at support@vinmain.com if you believe your account has been accessed without permission. We may suspend or close an account that we reasonably believe is being used fraudulently, by someone other than its owner, or in violation of these Terms.
Vehicle reports are assembled from data supplied by third-party providers, including vehicle specification, title, accident, recall, valuation, and ownership-history sources. You understand and agree that:
Reports can be incomplete. Not every accident, repair, title event, or lien is reported to the sources we use, and reporting delays are common. "No records found" means no record was found in the data available to us — it does not mean the event did not happen.
Reports are not a substitute for an inspection. Always have a vehicle inspected by a qualified mechanic and verify title status with the state before you buy.
Valuations are estimates. Market values shown in the Service are estimates generated from third-party models and are not offers to buy, sell, or finance at that value.
Reports are for your personal use. You may not resell, redistribute, scrape, or commercially reuse report data. Report content remains the property of VinMain and its data providers.
If you believe a report contains an error, contact support@vinmain.com with the VIN and the disputed item. We will route the dispute to the data provider and notify you of the result, but we cannot alter third-party source data ourselves.
Your authorization. When you submit a financing request, you instruct and authorize VinMain and the participating lenders you are matched with to obtain information about you, including consumer credit information from one or more consumer reporting agencies, for the purpose of evaluating your request. This authorization is your written instruction under the Fair Credit Reporting Act.
Soft inquiry at pre-qualification. The initial pre-qualification check is performed as a "soft" inquiry, which does not affect your credit score. If you proceed to a full application with a lender, that lender may perform a "hard" inquiry, which can affect your score. The lender will tell you before it does so.
What we share. To connect you with a lender, we transmit the information in your financing request — including identity, contact, income, residence, employment, and vehicle information, and any documents you upload — to the participating lenders you are matched with. Once a lender receives your information, its use of that information is governed by the lender's own privacy policy and agreements, not ours.
Lender decisions and notices. The lender, not VinMain, decides whether to make you an offer. If a lender declines your application or offers less favorable terms, the lender is responsible for sending you any legally required notice explaining the decision. VinMain will display the outcome the lender reports to us.
Accuracy of what you tell us. Providing false information on a financing request may be a crime and will result in termination of your account.
Membership. Many participating lenders are credit unions. You may be required to become a member of a credit union before it can fund a loan. Membership eligibility, fees, and terms are set by the credit union.
You may be asked to upload documents such as a driver's license, pay stubs, or proof of residence to complete a financing request. By uploading a document you confirm it is genuine and yours. We store uploaded documents securely, restrict access to them, share them only with the lender(s) evaluating your request, and delete them according to the schedule in our Privacy Policy.
Text messages. To create an account and sign in, we send one-time passcodes by SMS to the phone number you provide. By providing your number you consent to receive these service messages. Message and data rates may apply. Reply STOP to opt out; you will not be able to sign in without a verification method.
Marketing. We will not send you marketing text messages unless you separately opt in. You may withdraw that consent at any time.
Electronic records. You agree that we may provide notices, disclosures, reports, and records to you electronically, through the Service or to the email address on your account, and that electronic records and signatures have the same effect as paper. You may request a paper copy of any record by contacting support. To withdraw consent to electronic delivery, close your account.
Certain automated steps in the financing process — for example, a scoring or eligibility check — produce a record that is cryptographically signed and linked in a hash chain at the time it is created (an "HCAR Audit Record"). The Service lets you view your HCAR Audit Records and verify that a record has not been altered since it was sealed.
What verification means. A successful verification confirms that the record's contents are exactly what was sealed at the time shown, and that the record has not been changed. It does not confirm that the inputs to the decision were accurate, that the decision itself was correct, or that a lender was obligated to act on it. If you believe the information used in an automated step was wrong, use the dispute process in Section 4 or contact the lender.
Corrections. Sealed records are never edited. If a record is corrected, a new record referencing the original is sealed and both remain visible.
Ownership. HCAR and the underlying technology are owned by HZCA Technologies LLC and licensed to VinMain. Nothing in these Terms grants you any rights in HCAR beyond viewing and verifying your own records.
You agree not to:
use the Service for any purpose other than researching and financing a vehicle for your own personal use; run VIN lookups or reports for third parties, in bulk, or for resale; scrape, crawl, copy, reverse engineer, or interfere with the Service or its data providers; submit information about another person without that person's authorization; attempt to bypass rate limits, verification, or security controls; upload malware, or use the Service to violate any law or the rights of others.
We may rate-limit, suspend, or terminate accounts that violate this section, and we may report unlawful activity to law enforcement.
The Service, including its software, design, text, graphics, reports, and the names and logos VinMain, HZCA, and HCAR, is owned by VinMain or its licensors and is protected by copyright, trademark, and other laws. We grant you a limited, revocable, non-transferable license to use the Service for its intended purpose. You may not use our names or marks without written permission.
The Service relies on third-party data providers, credit bureaus, identity-verification vendors, payment and messaging providers, and lenders. We are not responsible for the availability, accuracy, or conduct of third parties, and links to third-party sites are provided for convenience only.
Our Privacy Policy explains what information we collect, how we use and share it, how long we keep it, and how to delete your account and data. You can request deletion from within the app or by emailing support@vinmain.com. Some records must be retained for a period after deletion to comply with law, including records related to credit requests.
THE SERVICE, ALL REPORTS, VALUATIONS, PRE-QUALIFICATION RESULTS, AND HCAR AUDIT RECORDS ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, VINMAIN DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. VINMAIN DOES NOT WARRANT THAT ANY REPORT IS COMPLETE, THAT ANY VEHICLE IS FREE OF DEFECTS, THAT YOU WILL RECEIVE A FINANCING OFFER, OR THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE.
TO THE FULLEST EXTENT PERMITTED BY LAW, VINMAIN AND ITS OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, LICENSORS, AND DATA PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE, ANY REPORT, OR ANY VEHICLE OR LOAN TRANSACTION, EVEN IF ADVISED OF THE POSSIBILITY. VINMAIN'S TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF ONE HUNDRED DOLLARS ($100) OR THE AMOUNT YOU PAID VINMAIN IN THE TWELVE MONTHS BEFORE THE CLAIM. SOME STATES DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THIS SECTION MAY NOT APPLY TO YOU.
You agree to indemnify and hold VinMain harmless from claims, losses, and expenses (including reasonable attorneys' fees) arising from your violation of these Terms, your misuse of the Service, or information you provide that is false or belongs to another person.
Talk to us first. Before starting any formal proceeding, email legal@vinmain.com with your name, account phone number, and a description of the dispute. We will try to resolve it within 30 days.
Binding arbitration. If we cannot resolve it, you and VinMain agree that any dispute arising out of or relating to the Service or these Terms will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court, except that either party may bring an individual claim in small-claims court. The Federal Arbitration Act governs this section. Arbitration will take place in Tarrant County, Texas, or by video, at your election. VinMain will pay the arbitration filing fees for claims under $10,000 unless the arbitrator finds the claim frivolous.
Class-action waiver. You and VinMain agree to bring claims only in an individual capacity, and not as a plaintiff or class member in any class, consolidated, or representative proceeding. The arbitrator may not consolidate claims of more than one person.
Opt-out. You may opt out of this arbitration agreement by emailing legal@vinmain.com with the subject line "Arbitration Opt-Out" within 30 days of first accepting these Terms. Opting out does not affect any other part of these Terms.
Exceptions. Nothing in this section prevents either party from seeking injunctive relief in court for infringement or misuse of intellectual property, or prevents you from filing a complaint with a government agency.
These Terms are governed by the laws of the State of Texas and applicable federal law, without regard to conflict-of-law rules. For any matter not subject to arbitration, you and VinMain consent to the exclusive jurisdiction of the state and federal courts located in Tarrant County, Texas.
We may modify or discontinue features at any time. We may update these Terms; when we do, we will change the version number and effective date above and, for material changes, notify you through the Service or by email at least 14 days before they take effect. Continued use after the effective date means you accept the updated Terms. The version of the Terms you accepted, and the date and time you accepted it, are recorded on your account.
You may close your account at any time. We may suspend or terminate your access for violation of these Terms, suspected fraud, legal requirement, or discontinuation of the Service. Sections 4, 8, 10, 13, 14, 15, and 16 survive termination.
These Terms, together with the Privacy Policy and any consents you give within the Service, are the entire agreement between you and VinMain about the Service. If any provision is found unenforceable, the rest remain in effect. You may not assign these Terms; VinMain may assign them to an affiliate or successor. Our failure to enforce a provision is not a waiver.
